MEMORANDUM OPINION


By letters dated September 15, 2004, the Court directed appellant Jeffrey Mingle to pay the filing fee and file the docketing statement for this appeal within ten days of the date of the letters. The letters warned appellant that failure to comply would result in dismissal of the appeal. By letter dated September 16, 2004, the Court directed appellant to file an amended notice of appeal within ten days of the date of the letter because appellant's original notice of appeal was defective. The letter warned appellant that failure to comply would result in dismissal of the appeal. To date, appellant has not paid the filing fee, filed the docketing statement, or filed an amended notice of appeal. Accordingly, the Court DISMISSES this appeal. Tex.R.App.P. 42.3.
