ORDER

1. the plaintiff's motion to remand (docket entry no. 10) is DENIED;
2. the plaintiff's motion to amend (docket entry no. 19) is DENIED;
3. the defendant's motion for partial dismissal (docket entry no. 7) is GRANTED; and
4. copies of this Order and the accompanying Memorandum shall be sent to counsel of record.
