OPINION


This matter is before the court on a motion for partial summary judgment filed on behalf on behalf of defendant The Dow Chemical Company. The plaintiff, Connie F. Mincey, has filed an opposition which the court has considered. Jurisdiction is allegedly based upon diversity 28 U.S.C. § 1332 and a federal question, 28 U.S.C. § 1331 as it relates to the Family Medical Leave Act (FMLA); 29 U.S.C. § 2601-2654, the Fair Labor Standards Act (FSLA; 29 U.S.C. § 201-219), and the Americans With Disabilities Act 42 U.S.C. § 12101, et seq.

For the written reasons to be filed at a later date,

IT IS ORDERED that the motion for partial summary judgment filed on behalf of defendant is GRANTED, as to plaintiffs claims of Family Medical Leave Act and Americans With Disabilities Act violations. The motion for partial summary judgment is DENIED as to plaintiffs claims of a Fair Labor Standards Act violation.
