ORDER DENYING MOTION TO DISMISS FOR LACK OF JURISDICTION AND ALLOWING FURTHER DISCO VERY


This case is before the court on Min Maw Precision Industry Corporation's motion to dismiss CableLink, Inc.'s third-party complaint for lack of personal jurisdiction (#10-1). On September 23, 2003, the court ordered CableLink to show cause why its complaint against Min Maw Precision Industry Corporation ("MMPIC") should not be dismissed for lack of personal jurisdiction. In its October 8, 2003 response, CableLink represented that some discovery had been exchanged on the jurisdictional issue, but requested additional time to conduct further discovery, until February 2, 2004. MMPIC objects to extending discovery.

Good cause appearing, the court overrules MMPIC's objection and GRANTS plaintiffs request for additional time to conduct discovery on the jurisdictional issue. The court ORDERS discovery on the jurisdictional issue extended until February 2, 2004. In light of the foregoing, the court DENIES MMPIC's motion to dismiss for lack of personal jurisdiction (#10-1) as premature and invites MMPIC to re-file its motion, if appropriate, after discovery has concluded on February 2, 2004.
