PRESENT: , P. J., CENTRA, FAHEY, PERADOTTO, AND CARNI, JJ.

Petitioner having moved for an extension of time to file and serve a brief on this CPLR article 78 proceeding transferred to this Court by order of the Supreme Court entered in the Office of the Clerk of the County of Monroe on July 3, 2012,

Now, upon reading and filing the affirmation of James S. Hinman, Esq., dated December 28, 2012, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the first ordering paragraph of the order of this Court entered November 29, 2012, is hereby amended by deleting the date December 28, 2012, and inserting in its place the date February 22, 2013, and the Clerk is directed to accept the brief for filing, and

It is further ORDERED that the second ordering paragraph of the order of this Court entered November 29, 2012, is hereby amended by deleting the date February 1, 2013, and inserting in its place the date March 29, 2013, and the Clerk is directed to accept the briefs for filing.

Memorandum: No further extensions of time to file and serve a petitioner's brief will be granted.
