Polina Milman v. Fieger & Fieger PC

LC No. 2021-188863-CB

Deborah A. Servitto Presiding Judge, Mark J. Cavanagh, Judge

ORDER

Elizabeth L. Gleicher, Judges

The motion for immediate consideration is GRANTED.

In lieu of granting leave to appeal, pursuant to MCR 7.205(E)(2), the Court orders that the Oakland Circuit Court's February 11, 2022 order is VACATED IN PART as follows. That portion of the February 11, 2022 order stating that objections "shall be limited to attorney-client privilege only" is hereby STRICKEN from the order. The trial court abused its discretion by imposing that condition as a sanction, which affects not only defendants but potentially affects third parties who are protected by other privileges. Hardrick v Auto Club Ins Assn, 294 Mich.App. 651, 659; 819 N.W.2d 28 (2011); Bass v Combs, 238 Mich.App. 16, 26; 604 N.W.2d 727 (1999). In all other respects the application for leave to appeal is DENIED.

This order is to have immediate effect. MCR 7.215(F)(2).

We do not retain jurisdiction.
