On Appeal from the 191st Judicial District Court Dallas County, Texas
Trial Court Cause No. DC-15-01598
ORDER
In the March 19, 2015 Temporary Injunction at issue in this accelerated appeal, the trial court found the general ledger of the Talley Dunn Gallery, LLC is confidential information that qualifies as a trade secret within the meaning of section 134A.002(6) of the Texas Uniform Trade Secrets Act, see TEX. CIV. PRAC. & REM. CODE ANN. § 134A.002(6) (West Supp. 2015), and the Talley Dunn Gallery, LLC had taken substantial measures to prevent its trade secrets and confidential information from becoming publicly available. Further, during the hearing on the Talley Dunn Gallery, LLC and Talley Dunn's request for a temporary injunction, the trial court evidenced an intent that the general ledger would be placed under temporary seal pending a trial on the merits. However, the record on appeal does not contain a written order by the trial court placing the general ledger under temporary seal, and the reporter's record contains copies of the general ledger.
On the Court's own motion, we ORDER plaintiff's exhibit 30, which is a CD, and volume 6, which is the second volume of the exhibits from the temporary injunction hearing, of the reporter's record sealed.
