MEMORANDUM OPINION


The trial court signed a final judgment on August 28, 2003. Appellant filed a motion for new trial on September 25, 2003. Appellant filed a notice of appeal on December 23, 2003. The Court sent appellant a letter on December 29, 2003 directing him to pay the $125 filing fee for this appeal within ten days of the date of the letter or the appeal would be dismissed. On January 5, 2004, the Court sent appellant a letter directing him to file a letter brief, within ten days of the date of the letter, explaining how the Court had jurisdiction over this appeal because appellant's notice of appeal was not timely filed. Appellant was warned that failure to comply result in dismissal of the appeal. To date, appellant has not paid the filing fee or filed the letter brief. Accordingly, the Court DISMISSES this appeal for want of prosecution. Tex.R.App.P. 42.3.
