On this day, the above styled matter came before the Court for consideration of Plaintiffs' and Defendants' objections to Magistrate Judge Seibert's November 4, 2004 and January 24, 2005 orders, Plaintiffs' motion to strike (Docket number 132), and Defendants' motion to stay Magistrate Judge Seibert's November 4, 2004 Order (Docket number 147).
After considering Magistrate Judge Seibert's orders, the documents and objections thereto, and the applicable law on point, the Court finds that the orders are not clearly erroneous or contrary to law. See Fed.R.Civ.P. 72(a).
Accordingly, the objections are hereby OVERRULED. The Court hereby ADOPTS by reference the reasoning provided in the Magistrate Judge's Orders. Defendant shall produce forthwith the documents described in the Magistrate Judge's Orders.
Plaintiffs' motion to strike affidavit (Docket number 132) is hereby DENIED AS MOOT. The Court previously ruled on the motion that was at issue. Thus, the issue of striking the affidavit submitted with Defendants' reply to Plaintiffs' response is moot.
Defendants' motion for stay of Magistrate Judge Seibert's November 5, 2004 Order (Docket number 147) is hereby DENIED AS MOOT. The Court previously ruled on the objections. Thus, the motion is moot.
