FINAL ORDER OF DISMISSAL WITH PREJUDICE AND ORDER DENYING ALL PENDING MOTIONS AS MOOT


THIS MATTER is before the Court upon the parties' stipulation for dismissal, which is attached and filed with this Order. It is:

ADJUDGED that this action is DISMISSED with prejudice. It is also:

ADJUDGED that all pending motions in this case are DENIED AS MOOT, and this case is CLOSED.

DONE AND ORDERED.

STIPULATION FOR DISMISSAL

RUSSELL MILLER, through undersigned counsel, and GARY POLK, through undersigned counsel, hereby stipulate to dismiss all actions filed against each other with prejudice, each party to bear their own fees and costs, and additionally, GARY POLK dismisses, without prejuice, his Third Party Claims against the Third Party Defendant, the Estate of David Goldberg (who never entered an appearance in the case).
