Appellant having moved, upon the return of an order to show cause granted by the Honorable Henry J. Scudder on July 15, 2011, for a stay of all proceedings to enforce the order of Supreme Court entered in the Office of the Clerk of the County of Monroe on July 8, 2011, pending the hearing and determination of the appeal taken herein, and for other relief, and respondent having cross-moved to adjourn the return date of said motion and to extend the time to file and serve papers opposing said motion,
Now, upon reading and filing the affirmation of Nathan A. Van Loon, Esq., dated July 14, 2011, the affidavit of Nicole Miller sworn to July 14, 2011, the affirmation of Michael D. Schmitt, Esq. received August 10, 2011, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the cross motion is granted, and appellant's motion is hereby adjourned, the new return date for appellant's motion is September 6, 2011, and all papers in opposition to appellant's motion shall be filed and served on or before August 26, 2011.
