DENISE MILLER, Appellant v. JOHN M. HENDERSON, M.D., Appellee

On Appeal from the 441st District Court Midland County, Texas
Trial Court Cause No. CV52184

MEMORANDUM OPINION

Denise Miller filed an interlocutory appeal from an order dismissing her cause of action against John M. Henderson, M.D. The trial court subsequently granted Miller's motion to vacate the trial court's prior order and gave Miller a thirty-day extension of time in which to file a supplemental expert report relating to Dr. Henderson. When we received the trial court's latter order, the clerk of this court notified the parties of this court's intent to dismiss this appeal. The parties were directed to file in this court any objection or response on or before June 12, 2017. Neither party has filed an objection or a response.

Consequently, we dismiss this appeal. See TEX. R. APP. P. 42.3.

PER CURIAM June 30, 2017 Panel consists of: Wright, C.J.,
Willson, J., and Bailey, J.
