ORDER GRANTING CONSENT MOTION FOR SUBSTITUTION OF PARTY

The Court, having considered the Consent Motion for Substitution of Party, hereby GRANTS the motion (ECF No. 230). Lisa Millen Harper and Robin Lynn Mahan, as Executors of the Estate of Mary Agnes Millen, are hereby substituted as a party in the place and stead of Agnes Millen, deceased plaintiff in the abovestyled case.
The Court previously vacated its summary judgment order as to the claims brought by Agnes Millen. Order (May 23, 2024), ECF No. 228. The Court also entered an order consolidating the other eleven remaining cases for trial during the November 2024 trial term and permitting additional sound measurements, expert disclosures, and expert depositions for those cases. Order (May 7, 2024), ECF No. 226. Given this posture, the Court finds that the Millen action, now being pursued by the executors of Agnes Millen's estate, should be consolidated for trial in November 2024 with the other remaining cases and should be subject to the same supplemental discovery schedule. Accordingly, the consolidation order (ECF No. 226 in 3:21-cv-42) is amended to include 3:21-cv-42 (Millen), and this action shall be subject to the deadlines set in the supplemental scheduling order (ECF No. 12 in 3:21-cv-47).
