Pending before the Court is respondent's Motion for Summary Judgment, filed February 20, 2024. By Order served February 21, 2024, the Court directed petitioner to file, on or before March 22, 2024, a response to that Motion. The Court thereafter extended to June 10, 2024, the time for petitioner to file such a response.
On June 11, 2024, the Court received and filed a Letter by Petitioner. In response, the Court convened a conference call with the parties on June 21, 2024. During the call, petitioner's representative confirmed that petitioner's current mailing address is the address in the Court's records and requested additional time to file a response to respondent's Motion.
Upon due consideration and for cause, it is
ORDERED that the above-referenced Letter by Petitioner is recharacterized as petitioner's Motion for Extension of Time. It is further
ORDERED that petitioner's Motion for Extension of Time is granted in that the time within which petitioner shall file a response to respondent's above-referenced Motion for Summary Judgment is extended to August 5, 2024. Failure to file a response as directed may result in the granting of that Motion and, if appropriate, the entry of decision against petitioner. See Rule 121(b), (d), Tax Court Rules of Practice and Procedure; see also Rule 123(b), Tax Court Rules of Practice and Procedure.
