ORDER

Travis A. Greaves, Judge

On December 8, 2023, respondent filed a Status Report in response to the Court's Order served on September 8, 2023. No response has been filed by or on behalf of petitioner.

Respondent indicated that counsel for co-executors of petitioner's estate intend on participating and prosecuting this case and are in the process of obtaining documentation to file a motion to substitute parties and change caption. However, no such motion has been received by the Court. The Court will grant the parties an additional 30 days to comply with the Court's Order to Show Cause served on September 8, 2023.

Premises considered, it is

ORDERED that the time within which the co-executors of petitioner's estate shall comply with the Court's Order to Show Cause issued September 8, 2023, is extended to February 28, 2024. It is further

ORDERED that, in addition to the regular service upon the parties, the Clerk of the Court shall serve a copy of this Order upon Mark Militana, Fred Militana, and Steve Fabian at their addresses listed for them in paragraph 8 of the Motion to Withdraw.

Failure to comply with this Order may result in dismissal of this case or other action as the Court deems appropriate.
