Ronald L. Buch, Judge.

This case is set for trial at the session of the Court scheduled to commence on January 30, 2023, in Miami, Florida. On January 6, 2023, the Commissioner filed a Motion to Dismiss for Lack of Prosecution, which the Court set for hearing at the trial session. On January 25, 2023, the Court held a conference call with the parties. They informed the Court that they are working toward resolving the case or better preparing it for trial. The Commissioner requested a continuance to which the petitioner agreed. Accordingly, it is

ORDERED that the Commissioner's Motion to Dismiss for Lack of Prosecution, filed January 6, 2023, is denied without prejudice. It is further

ORDERED that this case is stricken from the January 30, 2023, trial session, continued, and restored to the general docket.
