MICHAEL D MIER v. DEPARTMENT OF CORRECTIONS

LC No. 23-000116-MB

ORDER

Michael F. Gadola, Chief Judge, acting under MCR 7.211(E)(2), orders:

The motion to extend time to file cross-appellant's brief is GRANTED TO THE EXTENT that the time for filing cross-appellant's brief is EXTENDED until 56 days after a transcript of the January 23, 2024 hearing is filed with the trial court.

On the Court's own motion, within 14 days after the date of this order, appellant Department of Corrections shall secure the filing with this Court of a copy of a stenographer's certificate ordering preparation of a transcript of the January 23, 2024 hearing on an expedited basis. In this regard, appellant was required by MCR 7.210(B)(1)(a) to order preparation of a transcript of the January 23, 2024 hearing as part of the full transcript for this appeal. But appellant is not required to order transcripts of hearings held in March 2024 - after its claim of appeal was filed - as part of the "full transcript" for purposes of this appeal.
