Plaintiff having moved, upon the return of an order to show cause granted by the Honorable Rose H. Sconiers, for various relief pursuant to CPLR 5704 (a) and for other relief,

Now, upon reading and filing the affirmation of Michelle Maccagnano, Esq., dated June 17, 2013, said show cause order with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied on the ground that relief pursuant to CPLR 5704 (a) is inappropriate because plaintiff may take an appeal as of right from the order of the Supreme Court entered in the Office of the Clerk of the County of Onondaga on May 30, 2013 (see CPLR 5701 [a] [3]).
