MEMORANDUM AND ORDER


The defendants moved to supplement the record in this case by permitting Dr. Valliere to testify. Having received the notes of testimony of the hearing and the post hearing briefs, I think fairness requires that defendants, who claim to not have anticipated the issue of comparing living in Allentown versus Tobyhana, should be given the opportunity to do so. The original hearing was quickly scheduled upon filing of the petitioner for preliminary injunction. Thus, I can understand that defendants may not have anticipated the main issue before the court.

The following Order is entered:

ORDER

AND NOW, this 7th day of June, 2004, Defendants Motion To Supplement the Record (Docket No. 6) is GRANTED. A hearing is scheduled for Tuesday, June 29, 2004 at 9:30 a.m., in Courtroom 14A.
