ORDER AND DECISION

Juan F. Vasquez Judge.

On March 1, 2023, counsel for respondent filed with the Court a Motion for Summary Judgment. This case was called from the calendar for the trial session of the Court on May 22, 2023, for cases where Los Angeles, California, was listed as the place of trial. Counsel for petitioner and respondent appeared and were heard on the motion.

During the calendar call, counsel for petitioner stated that petitioner is withdrawing the objection to respondent's Motion for Summary Judgment. Counsel for respondent then orally moved for a Motion for Entry of Decision to which counsel for petitioner had no objection.

Upon due consideration, and for cause more fully appearing in the transcript of the above-referenced proceedings, it is

ORDERED that respondent's Motion for Summary Judgment, filed March 1, 2023, is denied as moot. It is further

ORDERED and DECIDED that respondent's oral motion for entry of decision, for the amount set forth in the Notice of Determination, dated September 28, 2022, with the exception of the amounts and periods already dismissed as moot, is granted.
