ERIC JASON MEYER, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Mark V. Holmes Judge

This case is on the Court's May 1, 2023 San Francisco, California trial calendar. It's based on a notice from the IRS that it intended to collect unpaid tax through a levy on petitioner's assets. On March 7, 2023 respondent moved without objection to remand the case to IRS Appeals because the IRS mailed the notice offering petitioner a CDP hearing to the wrong address. It is therefore

ORDERED that the Court's February 21, 2023 order setting deadlines for assembly of the administrative record is vacated. It is also

ORDERED that respondent's March 7, 2023 motion to remand to the IRS Independent Office of Appeals for issuance of a supplemental notice of determination is granted. It is also

ORDERED that this case is stricken from the Court's May 1, 2023 San Francisco trial calendar. It is also

ORDERED that this division of the Court retains jurisdiction. It is also

ORDERED that on or before July 21, 2023 the parties shall submit settlement documents or file a status report describing their progress.
