Opinion

Case No. SC04-1531.

April 19, 2005.

Lower Tribunal No. 5D03-1436.

Because it appears that the Fifth District Court of Appeal considered petitioner's "motion to proceed pro se and to extend time to file timely motion for rehearing" on the merits, the petition for writ of mandamus is hereby dismissed as moot.

PARIENTE, C.J., and WELLS, ANSTEAD, LEWIS, QUINCE, CANTERO and BELL, JJ., concur.
