It is hereby ORDERED, that the initial pre-trial conference in this matter is adjourned to September 6, 2002 at 4:30 p.m. It is further

ORDERED, that the parties shall file their Joint Preliminary Pre-Trial Statement, as described in this Court's Preliminary Pre-Trial Order, no later than August 30, 2002 (the "Extended Date"); and further

ORDERED, that if plaintiff fails to participate in the preparation and filing of the Joint Preliminary Pre-Trial Statement on or before the Extended Date, this action shall be dismissed, and further

ORDERED, that if defendant fails to participate in the preparation and filing of the Joint Preliminary Pre-Trial Statement on or before the Extended Date, defendant shall be precluded from offering any evidence at the trial of this action.
