This case is calendared for a remote trial at the session of the Court scheduled to commence on February 27, 2023, for cases in which Portland, Oregon, is the place of trial.

On February 6, 2023, respondent filed a motion to dismiss for failure to properly prosecute, indicating therein that petitioner's views as to the granting of respondent's motion are unknown.

Upon due consideration of the foregoing, it is

ORDERED that respondent's motion to dismiss for failure to properly prosecute filed February 6, 2023, is set for remote hearing on Monday, February 27, 2023, at 10:00 a.m. (PST) (1:00 p.m. EST). Petitioner is advised that failure to comply with this order or failure to appear at the remote hearing on February 27, 2023, may result in the Court granting respondent's motion and entering an order and decision against petitioner. It is further

ORDERED that the Clerk of the Court is directed to attach to this order a copy of the notice setting case for trial that was previously issued in this case on October 27, 2022.

This order constitutes official notice to the parties.
