This is an interlocutory appeal from the trial court's order, signed on October 3, 2024, denying Appellants' motion to compel arbitration and stay the underlying proceedings.
On October 8, 2024, Appellants filed an Emergency Motion to Stay, requesting that we stay all trial court proceedings during the pendency of their interlocutory appeal. They also filed a motion requesting we expedite consideration of their Emergency Motion because the deposition of their corporate representative has been ordered to take place on October 9, 2024, and "[a] stay of the trial court proceedings is necessary to preserve the parties' rights to arbitration pending the resolution of this appeal." Appellees filed a response arguing the Emergency Motion to Stay should be denied because Appellants did not move to quash the referenced deposition and the arbitration agreement does not prohibit depositions.
We grant Appellants' Emergency Motion to Stay and motion for expedited consideration.
All trial court proceedings in trial court case number 1206870 are hereby stayed until final resolution of this appeal or further order of this Court. See Tex. R. App. P. 29.3 (authorizing appellate court to make any temporary orders necessary to preserve parties' rights until disposition of appeal).
It is so ORDERED.
