Met International Trading Co., Inc. and Leaveil Skinner v. 49North LLC and Brandon Passe

County Civil Court at Law No. 2 of Harris County, Trial court case number: 1206870

ORDER

Veronica Rivas-Molloy, Judge

This is an interlocutory appeal from the trial court's order, signed on October 3, 2024, denying Appellants' motion to compel arbitration and stay the underlying trial proceedings.

On October 8, 2024, we granted Appellants' Emergency Motion to Stay, issuing an order, staying all trial court proceedings in trial court case number 1206870 pending final resolution of this appeal or until further order of this Court.

On October 9, 2024, Appellees filed a Motion to Stay and Amended Motion to Stay in this Court, explaining that Appellants had commenced arbitration proceedings against them and that, prior to our issued stay, Appellees had filed a Motion to Stay and Enjoin Arbitration in the trial court requesting that the trial court enjoin the arbitration proceedings. Appellees' Motion to Stay, filed in the trial court, was set for hearing on October 15, 2024. In their Amended Motion to Stay filed in this Court, Appellees requested that we stay the arbitration proceedings commenced by Appellants or, in the alternative, lift our stay to allow the trial court to consider and rule on Appellees' pending Motion to Stay and Enjoin Arbitration in the trial court then set for hearing on October 15, 2024.

On October 11, 2024, we granted in part and denied in part Appellees' Amended Motion to Stay, partially lifting the stay issued on October 8, 2024 to allow the trial court to consider and rule on Appellees' pending Motion to Stay and Enjoin Arbitration. The trial court held a hearing on Appellees' motion on October 15, 2017, and on October 17, 2024, it issued an order denying the motion.

On October 21, 2024, Appellees filed a Second Motion to Stay and Enjoin Arbitration in this Court, explaining that the trial court had denied their Motion to Stay and Enjoin Arbitration and requesting that we issue the relief the trial court denied.

Specifically, Appellees requested that this Court stay the arbitration proceedings commenced by Appellants.

Appellees' Second Motion to Stay and Enjoin Arbitration is denied.

It is so ORDERED.
