The opinion filed March 27, 2008 is modified as follows: On page 4 of the opinion, a footnote is added at the end of the third paragraph to read, "We do not consider this conviction when evaluating the sufficiency of the evidence." Subsequent footnotes in the opinion are renumbered to reflect this addition.

Respondents petition for rehearing filed April 10, 2008 is denied.

The modification does not affect the judgment.
