Opinion filed February 13, 1945 Released for publication March 5, 1945
INJUNCTIONS, § 187 — grounds for issuance of writ of ne exeat. On motion to dissolve temporary injunction to prevent wife from leaving jurisdiction, where it was alleged that husband while he lived with his wife, turned over to her practically all his earnings, that he was not living with her, that he demanded accounting and division of monies and securities which defendant denied him, and it appeared that she attempted to and did fraudulently conceal and dispose of assets which were involved in action, and where it required summary action by trial court to keep available until conclusion of litigation moneys and securities involved, held that facts alleged warranted injunctive relief, and that plaintiff would have been irreparably injured if temporary injunction did not issue.
