Stay order filed

The “Petition for Writ of Mandate, Prohibition, Review, or Other Appropriate Relief,” filed on December 24, 2020, will be treated as a petition for review filed the same date. The time for granting or denying review is extended to March 24, 2021. (Cal. Rules of Court, rule 8.512(b)(1).)

Good cause appearing, and based upon Deputy District Attorney Michelle Contois's representations, the Secretary of the Department of Corrections and Rehabilitation's January 4, 2021, application for an extension of time is granted. The Secretary's response to the petition for review is to be served upon petitioner and filed in this court on or before January 21, 2021.

Petitioner may file and serve a reply to the response on or before February 1, 2021.

The portion of the October 26, 2020, order issued in In re Merriman (Superior Court of California, County of Ventura, Case No. CR45651), directing petitioner to provide discoverable materials to the Attorney General, is stayed pending further order of this court.
