This case is currently calendared for trial during the Court's October 17, 2022, Boston, Massachusetts, trial session. On September 26, 2022, respondent filed a Motion to Dismiss for Lack of Prosecution. In the motion, respondent moves the Court to dismiss the case and find in its order that:

there is a reduced deficiency in tax and penalties, .. . which reflects no deficiency in tax due from petitioner and an overpayment due to petitioner for the taxable year 2017 in the amount of $8,061.00.

The Court wishes to have Ms. Merida's views on whether she agrees with the proposed resolution reflected in respondent's Motion. If she agrees with the proposed resolution, she should file a short response indicating her agreement. And if she disagrees with the proposed resolution, she should call Karen Jones, Chambers Administrator of the undersigned judge, at 202-521-0760 to schedule a conference call with the Court, or file a written response stating her objections.

Upon due consideration, it is hereby

ORDERED that, on or before October 10, 2022, Ms. Merida shall either serve on respondent and file with the Court a response to respondent's Motion to Dismiss for Lack of Prosecution or call Karen Jones, Chambers Administrator of the undersigned judge. It is further

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution is set for hearing at the Court's Boston, Massachusetts trial session scheduled to commence on October 17, 2022, at 10:00 a.m. in Room 5, 12th floor, McCormick Post Office & Courthouse, 5 Post Office Square, Boson, Massachusetts, 02109. Ms. Merida is advised that failure to comply with the terms of this Order or failure to appear at the hearing on October 17, 2022, may result in the Court granting respondent's motion and entering an order and decision.
