PRESENT:

An order having been entered on April 27, 2020, granting respondent-appellant's motion to perfect an appeal taken herein as a poor person and assigning Timothy R. Lovallo, Esq., as counsel to perfect the appeal, and an order having been entered on August 31, 2020, substituting David J. Pajak, Esq., as counsel to perfect the appeal,

Now, upon reading and filing the statement of David J. Pajak, Esq., dated September 8, 2020, and due deliberation having been had thereon,

It is hereby ORDERED that Charles J. Greenberg, Esq., 3840 East Robinson Road, Suite 318, Amherst, New York 14228, is hereby substituted as counsel to conduct the above-entitled appeal taken from an order of the Family Court, Erie County, entered December 5, 2019, in place and stead of David J. Pajak, Esq., and

It is further ORDERED that the Erie County Family Court Clerk provide Charles J. Greenberg, Esq. with copies of all papers and transcripts of stenographic or audiotaped minutes, if any, of the proceedings upon which the appeal is based, and

It is further ORDERED that the time to perfect the appeal is extended to November 27, 2020, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
