Appeal by respondent-appellant Mental Hygiene Legal Service on behalf of Aliza K., dismissed, without costs, by the Court of Appeals, sua sponte, upon the ground that the appeal does not lie to the Court of Appeals from the order of the Appellate Division granting a new hearing absent the filing by respondent-appellant of a stipulation for judgment absolute in the event of an affirmance ( see, N.Y. Const, art VI, § 3 [b]; CPLR 5601).
