Order denying defendant's motion to set aside and vacate the notice of examination of the defendant before trial reversed upon the law and the facts, without costs, and motion granted, without costs. ( Safrin v. Safrin, 205 App. Div. 628; Horsch v. Horsch, 206 id. 710; Hutaff v. Hutaff, 208 id. 745.) Lazansky, P.J., Young, Kapper, Scudder and Tompkins, JJ., concur.
