LARRY MENARD, Appellant, v. SHERRY L. CATHEY A/K/A SHERRY L. KUENSTLER AND RICHARD KUENSTLER, Appellees.

ON APPEAL FROM THE 135TH DISTRICT COURT OF GOLIAD COUNTY, TEXAS

Before Justices Benavides, Tijerina, and Silva, J.

ORDER TO FILE APPELLANT'S BRIEF

PER CURIAM.

This case is currently before the Court on appellant's second motion for extension of time to file the brief. After one previous extension, appellant's brief was due to be filed on March 26, 2024. Appellant is requesting an additional sixty days to file the brief.

The Court looks with disfavor upon the delay caused by appellant's counsel's failure to timely file the brief. However, the Court, having fully examined and considered appellant's second motion for extension of time to file the brief and the extension previously granted in this case, is of the opinion that, in the interest of justice, appellant's second motion for extension of time to file the brief should be granted with an order.

Accordingly, appellant's second motion for extension of time to file the brief is hereby GRANTED. IT IS THEREFORE ORDERED that the Honorable Bianca Vela-Collins, counsel for appellant, file the appellate brief with this Court on or before 5:00 p.m. on May 28, 2024.
