Opinion

Upon consideration of the order sought to be appealed, the briefs, the record, and the motion to dismiss and response (carried with the case pursuant to an order entered October 14, 2013), the Court concludes that it lacks jurisdiction. See Federated Nat. Ins. Co. v. Palenzuela, 11 So.3d 969 (Fla. 3d DCA 2009). Accordingly, this case is dismissed.

The appellant's request for oral argument and motion for appellate attorney's fees are denied. The appellee's motion for appellate attorney's fees and costs is conditionally granted and remanded to the trial court to fix amount.
