An appeal having been taken from an order of the Supreme Court, New York County, entered on or about August 16, 2017, and from an order of the same Court and Justice entered on or about August 31, 2017, and said appeal having been perfected, And plaintiff-respondent having moved for a calendar preference maintaining the aforesaid appeal on this Court's calendar for the December 2017 Term, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, it is Ordered that the motion is granted, without prejudice to defendants raising the arguments presented here on appeal.
