JEFFREY MELCER & ADINA MELCER, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Christian N. Weiler, Judge.

This case is calendared for trial on the Court's May 16, 2022, New York City, New York trial session. On April 14, 2022, respondent filed an unopposed motion for continuance and asks that the Court restore this case to the general docket. The motion states that the appeals officer assigned to the case was unable to reach a settlement with petitioners, and the case was sent back to respondent's counsel for trial preparation. After receiving the case back for trial preparation, respondent's counsel discovered that the computations per the Notice of Deficiency may contain errors. Respondent's counsel has since requested tax computations from respondent's Tax Computations Services department and is awaiting receipt of the tax computations.

Upon due consideration, it is

ORDERED that respondent's motion for continuance is granted and this case is stricken from the May 16, 2022, New York City, New York trial session and is continued generally.
