SIDRICK RAYMONE MELANCON, SR. v. THE STATE.


The Honorable Supreme Court met pursuant to adjournment.

The following order was passed.

The Supreme Court today granted the writ of certiorari in this case as case No. S23G1128 .

This case will be assigned to the April 2024 oral argument calendar automatically under Supreme Court Rule 50 (1) (a). Oral argument is mandatory in granted certiorari cases.

This Court is particularly concerned with the following issue or issues:

1) Did the evidence authorize the jury to conclude that the defendant proximately caused the victim's death in the commission of cruelty to children in the second degree-as required to support his conviction for second-degree murder-by "causing" his girlfriend to "not cooperate with a Division of Family and Children Services investigation into the abuse of" the victim by her mother, as alleged in the indictment? See OCGA §§ 16-5-1 (d), 16-5-70 (c), &16-2-1 (b); Eubanks v. State, __Ga. __(894 S.E.2d 27) (2023).

Briefs should be submitted only on these points. See Supreme Court Rule 45.
