Appellant, Sixto P. Mejia, has filed a motion for an extension of time to file appellant's brief. Although the clerk's record has been filed, the time for filing Appellant's brief has not begun to run because the reporter's record has not been filed. See Tex. R. App. P. 38.6(a) (appellants' brief due 30 days after later of filing of clerk's record or filing of reporter's record). Accordingly, appellant's motion for an extension of time is dismissed as moot.
We further note that the reporter's record was due to be filed February 7, 2022. On February 28, 2022, the court reporter responsible for preparing the record in this appeal informed the Court that appellant has not requested preparation of the reporter's record. On the same day, the Clerk of this Court notified appellant that unless appellant provided written evidence that he has paid, or made arrangements to pay, for the reporter's record by March 15, 2022, the Court might consider the appeal without a reporter's record. See Tex. R. App. P. 37.3(c). This order serves as appellant's final notice that, unless appellant submits written evidence confirming that he has paid or made arrangements to pay the reporter's fee for preparing the reporter's record by March 28, 2022, the Court may require appellant to file his brief and decide the appeal without the reporter's record.
