Appellant's brief is overdue. On March 28, 2024, attorney Valencia Bush was appointed by the trial court to represent appellant in this appeal. On March 29, 2024, this Court ordered Ms. Bush to file appellant's brief by April 29, 2024. When the brief was not filed by July 9, 2024, this Court abated the appeal for the trial court to make findings pursuant to Rule of Appellate Procedure 38.8(b)(2). The trial court found that Ms. Bush "anticipates having this brief submitted to the Court of Appeals by August the 29th." On August 27, 2024, Ms. Bush filed a request for extension of time to file the reporter's record through September 27, 2024. This Court granted the extension. As of the date of this order, appellant's brief has not been filed. None of Ms. Bush's statements concerning this case indicate that she has begun work on the appeal.

We ORDER Valencia Bush to file appellant's brief on or before OCTOBER 17, 2024. If appellant's brief is not filed by that date, the Court will order Valencia Bush removed as appointed counsel for appellant and will order the trial court to appoint new counsel for appellant.

We DIRECT the Clerk to send copies of this order to the Honorable Stephanie Huff, Presiding Judge, 291st Judicial District Court; and counsel for all parties.
