ORDER
Before the Court is the State's May 28, 2020 motion objecting to the supplemental clerk's record filed April 21, 2020. In the motion, the State argues that the supplementation is inappropriate because it includes documents that were "not otherwise part of the trial court record." The State asks us to strike the supplemental clerk's record or alternatively to ask the district clerk "to certify whether or not the emails were a part of the trial court's record before Appellant's counsel sent them on April 20, 2020 as attachments to her letter."
We GRANT the State's motion to the extent we ORDER Collin County District Clerk Lynne Finley to certify whether or not the documents included in the April 21, 2020 supplemental clerk's record filed with this Court were part of the trial court's record before appellant's counsel mailed them to the district clerk and to file said certification with this Court within TWELVE DAYS of the date of this order.
The Court will defer ruling on the remainder of the State's May 28, 2020 until after the Collin County District Clerk files the certification.
We DIRECT the Clerk to send copies of this order to the Honorable Tom Nowak, Presiding Judge, 366th Judicial District Court; to Collin County District Clerk Lynne Finley; and to counsel for all parties.
