Opinion
No. 04-19-00056-CR
06-19-2019
From the 187th Judicial District Court, Bexar County, Texas
Trial Court No. 2017CR9848
The Honorable Stephanie R. Boyd, Judge Presiding
CORRECTED ORDER
On May 10, 2019, we abated this appeal and remanded it to the trial court to conduct a hearing to determine whether appellant, Amanda Medina, still desires to prosecute her appeal, whether appointed counsel, Michael Raign, has abandoned the appeal, and whether appellant is indigent, and to appoint new counsel if warranted. On May 31, 2019, appellant appeared in person and through counsel and presented evidence on these issues. After hearing the evidence, the trial court forwarded a transcript of the hearing and its findings of fact and conclusions of law to this court. The trial court found that appellant still desires to prosecute this appeal. The court also found that counsel Michael Raign accepted employment with the Bexar County District Attorney's office, effective May 1, 2019, and thus has a conflict of interest that precludes him from further representing appellant. The trial court allowed counsel to withdraw and appointed Vikash Bhakta to represent Medina in this appeal.
We reinstate this appeal on the docket of the court and adopt the findings and conclusions of the trial court. We order appellant's brief due July 19, 2019.
