MEMORANDUM OPINION


By letter dated August 27, 2004, the Court notified appellant that his notice of appeal was defective and directed appellant to file an amended notice of appeal within ten days of the date of the letter. The letter also advised appellant that the Court questioned it jurisdiction over the appeal and directed appellant to file a jurisdictional letter brief within ten days of the date of the letter. The letter warned appellant that failure to comply would result in dismissal of the appeal. On September 8, 2004, the Court granted appellant's request for an extension of time to file the amended notice of appeal and jurisdictional brief. The Court ordered appellant to file the amended notice of appeal and letter brief no later than October 7, 2004. By letter dated September 29, 2004, the Court directed appellant to pay for or make arrangements to pay for the clerk's record within ten days of the date of the letter. The letter warned appellant that failure to comply would result in dismissal of the appeal. To date, appellant has not filed the amended notice of appeal or the letter brief, and appellant has not paid for the clerk's record. Accordingly, the Court DISMISSES this appeal. Tex.R.App.P. 42.3.
