Robert MEDINA and Christina Medina, Appellants v. Timothy K. BOWERS, Appellee

From the 150th Judicial District Court, Bexar County, Texas
Trial Court No. 2013-CI-11752
Honorable Michael E. Mery, Judge Presiding

ORDER

Before the Court are Appellee's amended objection to defective reporter's record, appellants' response, and the court reporter's notice of late record.

Following Appellants' designation of partial reporter's record and statement of issues, Appellee filed a designation and second designation of additional matters to be included in the reporter's record. Appellants objected to appellee's designations. On April 7, 2017, this Court issued an order overruling appellants' objections and requiring the matters requested in appellee's designation and second designation to be included in the reporter's record.

In the notice of late record, the court reporter asserts items 6, 7, and 8 in appellee's designation of additional matters are ambiguous, and she requests clarity and specificity of the matters requested in these items.

Therefore, it is ORDERED that appellees file and provide to the court reporter a supplement to the designation of additional matters to be included in the record. In this supplement, appellees must specify the matters requested in items 6, 7, and 8 by identifying the witness testimony in which the items may be located, identifying where any objections or rulings on admission of exhibits might be located in the trial record, and clarifying the matters requested in item 8 and where these matters might be located in the trial record.

Appellees must file and provide this clarification to the court reporter on or before May 22, 2017. If this supplement is not filed and provided to the court reporter by this date, the matters shall be deemed waived and the reporter's record shall be filed without these items.

The full reporter's record, including all matters requested by appellees, shall be filed on or before June 22, 2017. Appellants shall bear the costs of the full reporter's record, including the matters requested by appellees.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 12th day of May, 2017.
