Opinion
No. 04-20-00051-CV
07-23-2020
From the 407th Judicial District Court, Bexar County, Texas
Trial Court No. 2019-CI-22706
Honorable Karen H. Pozza, Judge Presiding
ORDER
On February 3, 2020, appellee John Salas filed a notice of appeal, stating his desire to appeal to an amended final order signed on November 18, 2019. The appellate record was completed on March 17, 2020, making appellee's cross-appellant's brief due by April 16, 2020. See TEX. R. APP. P. 38.6(a). Neither a cross-appellant's brief nor motion for extension of time has been filed. We therefore ORDER appellee to file by August 3, 2020 his cross-appellant's brief and a written response explaining his failure to timely file the brief. If appellee fails to timely file a brief and response by the date ordered, we will dismiss the cross-appeal for want of prosecution. See id. R. 38.8(a), 42.3(c) (allowing involuntary dismissal if appellant fails to comply with court order). Should appellee choose to include his cross-appellant points in his appellee's brief, he must file a motion for leave requesting such relief by July 29, 2020.
