ORDER


The parties appeared before the court for a hearing on defendants' Motion to Dismiss, held July 6, 2004. Scott Cheney, Assistant Attorney General, appeared on behalf of defendants. Plaintiff was represented by Cory B Mattson.

After reviewing the memoranda of the parties, having heard oral argument, and for good cause appearing the Court ordered as follows:

1. The Motion is DENIED as to plaintiff's First Claim for Relief.

2. The Motion is GRANTED as to plaintiff's Eighth Claim for Relief.

3. The Motion is GRANTED as to Claims for Relief 2 through 7, the state tort claims, provided however, that the plaintiff shall have until July 26, 2004 to file an amended complaint as to those claims.
