Mears v. State

District Court of Appeal of Florida, First District
Aug 7, 1998
715 So. 2d 338 (Fla. Dist. Ct. App. 1998)

Opinion

No. 96-4878.

August 7, 1998.

An appeal from the Circuit Court for Liberty County; P. Kevin Davey, Judge.

Nancy A. Daniels, Public Defender; Carol Ann Turner, Assistant Public Defender, Tallahassee, for Appellant.

Robert A. Butterworth, Attorney General; Denise O. Simpson, Assistant Attorney General, Tallahassee, for Appellee.

Having reviewed the record on this appeal, and having considered the arguments contained in the briefs, we conclude that the only issue properly before us is moot. See Godwin v. State, 593 So.2d 211, 212 (Fla. 1992) ("An issue is moot when the controversy has been so fully resolved that a judicial determination can have no actual effect"). Accordingly, the appeal is dismissed.

APPEAL DISMISSED.

MINER and WEBSTER, JJ. and SMITH, LARRY G., Senior Judge, concur.
