MEMORANDUM OPINION


A jury convicted Richard Anthony McRae of driving while intoxicated, see Tex. Pen. Code Ann. § 49.04 (Vernon 2003), and assessed punishment at seventy-two hours' confinement in jail and a $1500 fine. We adopted the trial court's finding that appellant has abandoned the appeal, and we submitted the appeal without briefs. See Tex. R. App. P. 38.8(b)(4) (Vernon 2003). Absent briefs, no issues are before us. Finding no fundamental error, we affirm the trial court's judgment.
