On Appeal from the 247th District Court Harris County, Texas
Trial Court Cause No. 2011-32970
MEMORANDUM OPINION
This is an appeal from a final enforcement order signed November 4, 2019. On February 13, 2020, the parties filed a joint motion to dismiss the appeal. See Tex. R. App. P. 42.1. The parties asked the court to set aside the trial court's judgment and render a judgment effectuating the parties' agreement. See Tex. R. App. P. 42.1(a)(2)(A). That motion was denied for the reasons set forth in our order of March 26, 2020.
On April 21, 2020, appellant filed an amended motion to dismiss the appeal. See Tex. R. App. P. 42.1(a)(1). Appellant again requested this court to render a judgment effectuating the parties' agreement. See Tex. R. App. P. 42.1(a)(2). That motion was denied for the reasons set forth in our order of July 9, 2020.
In that order, we notified the parties that it appeared this appeal is moot. See Rapp v. Mandell & Wright, 123 S.W.3d 431, 436 (Tex. App.—Houston [14th Dist.] 2003, pet. denied) (release of judgment from which appeal was taken rendered the appeal moot). The parties were informed that the court would consider dismissal of the appeal on its own motion for want of jurisdiction unless any party filed a response by July 20, 2020, showing meritorious grounds for continuing the appeal. No response has been filed.
We dismiss the appeal.
PER CURIAM Panel consists of Chief Justice Frost and Justices Jewell and Spain.
