Eric Demond McNeil, Appellant v. The State of Texas

On Appeal from Criminal District Court No. 3 Tarrant County, Texas Trial Court No. 1751507R

Panel: Kerr, Birdwell, and Walker, JJ.

ORDER

Brian Walker Justice

On November 30, 2023, we issued our opinion which affirmed the trial court's judgment in this case. See McNeil v. State, No. 02-22-00277-CR, 2023 WL 8268054, at *4 (Tex. App.-Fort Worth Nov. 30, 2023, no pet. h.). On December 27, 2023, we received Appellant's "Motion for Rehearing." [Mot.] Because it was filed more than fifteen days after the opinion's issuance, we notified Appellant that his motion was untimely and requested that he file a motion for leave to file an untimely motion for rehearing. See Tex. R. App. P. 49.1 (requiring motions for rehearing be filed within fifteen days of appellate court's rendering of judgment). Appellant did not file a motion for leave or otherwise respond to our notice.

Accordingly, it is the opinion of the court that the motion for rehearing should be and is hereby denied and that the opinion and judgment of November 30, 2023, stand unchanged.

Even had we reached the merits raised in Appellant's motion, we would have denied the motion because it did not raise any issues requiring reconsideration of our November 30, 2023 opinion.

We direct the clerk of this court to send a notice of this order to the attorneys of record.
